8. Limitation of Liability
8.1 In no event shall we be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our platform.
9. Modifications to Terms
9.1 We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting on our platform. Continued use of our services after the posting of revised terms constitutes acceptance of those changes.
10. Refunds and Cancellations
10.1 Upon termination of a Subscription, you will retain access to the pertinent Creator's Content until the conclusion of the subscription period during which the cancellation occurred. Subsequent to this period, no further financial transactions will be processed from your designated payment method for Subscriptions associated with that particular Creator's profile. However, you will have the option to reinstate access by initiating a new Subscription to the same Creator's profile if desired. In the absence of such action, your ability to view the Creator's Content will be revoked after the current subscription period expires.
10.2 Refunds: By default, purchases and fees linked to your account are final and nonrefundable. Nonetheless, we retain the right to consider refund requests and may grant refunds in suitable situations, at our sole discretion.
10.3 Prepaid Balance: Our platform offers the convenience of prepaying a monetary sum, referred to as a "Prepaid Balance," and stored in your Wallet which can subsequently be utilized for making payments. It is important to note that transactions on our platform cannot be divided or split. In the event that you attempt a purchase exceeding the total amount of your remaining Prepaid Balance, your designated payment card will be charged the full amount for that particular transaction. The Prepaid Balance is subject to a maximum limit, which may be adjusted periodically at our discretion. No interest will accrue on the Prepaid Balance. Furthermore, the Prepaid Balance is non-refundable, meaning you will not be eligible to receive a refund for any unused portion of the Prepaid Balance.
10.4 Creator Accountability for Reversed Transactions: In the event that a Fan successfully obtains a refund concerning a Fan Payment made to a Creator, our platform reserves the right to conduct an investigation. Subsequent to this inquiry, we may exercise the discretion to deduct an amount equivalent to the Creator's Earnings derived from the reversed or refunded transaction from the Creator's account balance.
11. Governing Law
11.1 These Terms of Service shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law principles.
